Please carefully read these terms in full. By making a payment through Wave, Client acknowledges that Client has read and agrees to the terms outlined below.
billing + additional costs
flat payment structure
Payment will be conducted through Wave. All prices are listed in US dollars. Any associated wiring and payment fees are the responsibility of Client and cannot be passed on to TMP without approval. TMP accepts major credit cards, ACH and Zelle.
As compensation for flat rate services, TMP will invoice Client as follows —
For projects under $2,100 — 100% payment required up front
For projects between $2,100 and $4,500 — 50% payment at project initiation + 50% payment at project completion
For projects over $4,500 — 50% payment released up front + 25% payment released at the first presentation + 25% payment released at project completion
hourly payment structure
Hourly projects may require full payment upfront. For projects that are billed hourly, edit rounds will be billed separately from the initial block of time reserved for design and buildout. If off-boarding is not agreed upon at the time of the initial payment, an additional charge may be added if Client chooses to add-on an off-boarding call.
hourly edit/revision blocks
One hour of revisions is included in most packages unless otherwise noted. If additional hours are required and requested, the following options are available —
1 hour block — $200/hr
4 hour block — $500 USD, valued at $800 USD
1/2 day block — $800 USD, valued at $1400 USD
Full day block — $1600 USD, valued at $3200 USD
inactive projects + cancelations
Projects will be considered inactive and placed on hold after 30 days of client unresponsiveness or lack of final project approval and payment for remaining balance will be required. TMP will deliver the design assets as completed upon receiving payment. TMP will provide a new project timeline if applicable. TMP reserves the right to end contract at this time and establish new contract with Client for any additional work.
Should this project be canceled prior to completion, Client agrees to compensate TMP for all personnel hours and expenses incurred or non-cancellable pending to-date at $200/hr. If this amount exceeds the deposit amount, TMP will bill Client for the remaining balance. By accepting our quote through Wave, Client agrees to pay the remaining balance invoiced. Should it be less than the deposit amount, Client agrees to forgo the deposit to TMP for work done.
additional costs
Once project is finalized and all deliverables have been completed, TMP will invoice client for any additional costs incurred for payment through Wave. Once TMP receives final payment, the ownership of the website will be transferred into Client’s name. Client agrees to put a small link in footer pointing to TMP’s website. If Client chooses to remove this link or credit, Client agrees to pay an associated fee.
Hard costs including stock photography and hosting fees are not included in this estimate, and will be billed separately and passed through without markup. Any additional costs will be approved by Client before purchase by TMP. Any website hosting and domain fees incurred will be the responsibility of Client, and any out of pocket costs paid by TMP will be reimbursed by Client at time of final billing.
rights
Upon completion of design and transfer of final deliverable, Client will own all design rights to assets created by TMP for the explicit use of Client. TMP reserves the right to use designs created for Client on approved upon assets for promotional purposes.
guarantee
TMP’s design will be in the direction of the Client’s preferences. The design does not guarantee any monetary gain for Client. By signing this contract, Client agrees sole responsibility, releases TMP of any liability, and will not hold TMP accountable for sales or any monetary gain associated with the design.
wix trial expiration notification
In the event that Client does not purchase a Wix plan within the trial period, content may be deleted permanently or taken down by Wix. TMP is not responsible for maintaining copies of site and reserves the right to charge $200/hr for the site rebuild.
search engine optimization (SEO) and placement
TMP may offer Search Engine Optimization (SEO) services as part of the website development and management process. These services aim to enhance the visibility of the Client's website on search engines and improve its search engine rankings. However, it is important to note that TMP does not guarantee specific placement in search engine results or specific levels of traffic, leads, or conversions. TMP shall not be held liable for any changes in search engine rankings, traffic fluctuations, or any potential impact on the Client's business as a result of SEO activities. Any decisions made based on the expectation of specific search engine placement or rankings are the sole responsibility of the Client.
Web Accessibility Remediation
According to ADA Title III, every business website must be accessible to people with disabilities, or it may be at risk of lawsuits and unnecessary legal expenses. Wix provides built-in accessibility functionality—such as responsive design, semantic heading structures, keyboard navigation, color contrast settings, and the ability to add alt text to images—which offers a strong baseline.
For enhanced compliance, we recommend consulting with a trusted accessibility expert or using reputable tools aligned with WCAG guidelines. You may also be eligible for a $5,000 IRS tax credit for services rendered to make your site accessibility compliant. Please consult your accountant for details.
